I was given the ds action replay by my friend b/c he said it was ruining his game. I noticed that it had cheats for shiny pokemon. Is it technically legal (nintendo WiFi wise) for me to make my pokes shiny?

It's fine as long as they don't have illegal stats, or illegal movesets.

Hacks are generally classed as illegal, as if you can hack shininess then you can hack everything and give yourself an unfair advantage. But so long as your pokes aren't obviously hacked and you don't tell the opponent then you should be ok.
