My theory for Arcanine's non-legendary legendary status is because there are certain non-legendary Pokemon that are told about in myths, possibly Arcanine more than others. For example, Manaphy and Lapras. Manaphy is the "Prince of the Seas," and Lapras is the "King of the Seas". Lapras isn't a legendary, but Manaphy is.
And the tale about Ninetales in PMD. No other Pokemon has the ability to curse another that bad. Not even legendaries.
And Charmander's tail. No other Pokemon is so weak, not even MAGIKARP.
And the theory of Gyrados having dragon DNA. Other Pokemon other than Lapras, Aerodactyl, Tyranitar and Charzard that I can think of at the top of my head that have Dragon DNA and aren't actually Dragon types.
And the myth going around some crazed fans that Magikarp is the true creator, and not Mew or Arceus.
All of these contribute.

What do you mean by the Charmander part? It certainly isn't that weak. =/
Anyway, the information I found is most likely true, but I don't know for certain if it is or not so I'm not completely 100% sure on it. It sounds like the most reasonable answer though.

I believe the legend of that if a Charmander's tail flame goes out, so does it's life end. Meaning, it's a rather fragile Pokemon in the Anime view, because of natural weather and all.
Anywai, I'm sticking to Arcanine being considered some sort of Legendary-esque beast from China.

probably not important but if u look closely arca nine 9 which could suport the teory that arcanine was supposed to be the trio master since 1+2+3+3(the number of birds)=9

I do think Arcanine was meant to be a legendary. It seems like they had ideas for him, he has pretty good stats. Even though his stats are definitely not legendary calibur.
The three bird idea was a better a choice though. Now every region has three of something.
I don't think Arcanine would be a cool legend though, I like him as a regular Pokemon.

I plainly think that Arcanine doesn't have a legendary status because Arcanine considered to be 'legendary' by the eyes of the Chinese people. In most other peoples mind, all they probably assume is that the term 'legendary' means uber, but to the Chinese, Arcanine seems to be a rare sight; seeing Arcanine's majestic body and speed, it's no wonder why they tagged him/her as 'legendary'. In conclusion, the reason why Arcanine is the Legendary Pokemon is because the Chinese see Arcanine as supernatural
